Introduction

Dear Sparklers,
As you can imagine, your privacy is incredibly important to us and we want to make sure that you are aware exactly how we use and protect your information while we continue to strive to deliver the best dating experience in the world. The Privacy Policy is to be used in conjunction with the Terms of Service Agreement, which takes precedence. Note that we have tried to make our privacy policy read clearly in English... not "lawyerspeak."

BY USING OUR WEBSITE, YOU ACCEPT THE PRACTICES SET OUT IN THIS PRIVACY STATEMENT AND THE APPLICABLE TERMS OF SERVICE AGREEMENT.

Note that we do not knowingly target or collect information from children under 13 years of age. In fact, we restrict the use of our service to adults who are at least 18 years old. This is extremely important to us - if you suspect a minor is using our services, please let us know immediately by calling customer service or e-mailing service@sparkology.com.

Information We Collect

When registering for our services and completing a profile or user account, you provide us with personally identifiable information. We must be able to store and use this information to provide our services; to be on the safe side, we wanted to tell you more about what we store and what it's used for.

Personal Information

Users submit two types of personal information: that which we keep strictly confidential and that which we show to other users and third party service provides (for example, our concierges) in providing our services. Examples of confidential data that we never share include: physical address and billing information. Examples of data that we may share include photographs, personal descriptions, age, and, in very limited situations, (for example, when you purchase our concierge service) your phone number.

Note that we store your e-mail for communication and identification purposes. You may opt out of e-mail communication – please refer to the "Communications" section for further detail.

Non-personal Information

Sparkology may also log non-personally-identifiable information including IP address, aggregate User data, demographic data, cookie information, and browser type from users. We use this data to manage the website, prevent click fraud, track usage, and improve the services. You can adjust the settings in your internet browser to block all or some cookies, but note that this may reduce the quality of your experience.

Other Uses of Information

Sparkology may use your photographs, user names, feedback, and success stories that you share with us to further promote our services and bring even more high quality users onto our platform for you to meet.

We operate a community of intelligent, successful, and high-quality members and encourage you to participate in surveys, forums, or polls that benefit yourself, your peers, and our ability to deliver a great service. Your submissions to these may be shared with other users, in which case your profile may be linked with your submission. Aggregate results may be shared publicly. Confidential personal data is not shared with anyone and personal profile data is not shared publicly. Please be careful not to expose your own confidential information when responding to surveys, forums, or polls.

Sparkology may hold optional sweepstakes or contests from time to time where participation may require you to submit information that may be shared in other ways. This will be explicitly stated during such contests and you should read the specific terms of such contests before choosing to participate.

Required Information Disclosures

There may be specific times when we must disclose information, including personally identifiable and confidential information. We hope you understand the reasons behind these:

  • When required by legal subpoena, court order, or request for cooperation from law enforcement or other government agencies, to establish our legal rights, or to defend against legal claims.
  • In efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud, or other wrongdoing
  • To protect and defend the rights, property, or safety of our users, our company, or our employees
  • To enforce our website terms and conditions or other agreements or policies that you have agreed to

Advertisers and Partners

Don't worry: Sparkology does not sell your personally identifiable information or your profile to anyone! Seriously. We know other sites do this and we think you deserve better. We may, however, allow advertisers or partners to target specific ads or promotions towards a specific demographic or subset of our user base. This leads to a better experience for both the advertiser and our users: for example, would male users really want to see ads for feminine hygiene products? In doing so, we let the advertisers or partners define the subset they would like to target but Sparkology handles the actual delivery of the materials; the advertisers do not receive your information unless you interact with their services. In such cases, and as outlined in detail in our Terms of Service Agreement, Sparkology is not liable for your interactions with 3rd parties.

Transactional Information

We want to handle any and all customer service questions with complete transparency and fairness. Therefore, we may keep a record of all transactions on the site, including monetary transactions, interactions with other users, e-mail interactions, and interactions with our website. We are not obligated to keep these records, except as required by law or in agreements with vendors, including merchant processors and payment gateways.

Financial Information

Sparkology is a quality-driven paid service. Therefore, we store and use financial information and payment methods from all members to process your transactions quickly and efficiently. We care strongly about your user experience on our website.

By making a purchase on the website, or accessing any financial transaction or activity on the website, you automatically consent to allowing us to provide your financial information to our service providers, as well as your credit card issuer for their assistance in processing your transaction. Your financial activity on the website also allows us to contact any other third parties we determine as necessary to process your transactions. These third parties may include banking facilities and credit card institutions used to process and verify your financial transaction.

Friends

By far, your personal referrals are the most important way for Sparkology to grow. We are incredibly thankful for your referrals and see each referral as an acknowledgement of the hard work we are putting in to make this service superior. When you submit a referral, you also submit your friend's information (for example, name and email). We need to store this information so that we can effectively send them their secret invitation link.

International Use

This section should not apply to any members, as we focus only on major cities within the U.S., but we need to say it anyway:

Sparkology is located in the United States and is meant to serve U.S. customers logging on within the U.S. only. You should not use this service if you are not in the U.S. However, if you are logging in from a different country, you should note that these countries may have different privacy policy laws. By using this site, your data is transferred to the U.S. and is subject to U.S. privacy policy laws and regulations.

Revisions and Modifications

Sparkology is a growing company and will need to make changes to this Privacy Policy to reflect any changes in our business. Rest assured knowing that we will not forget our core principle of providing an elite service and if we make any material changes to our policy, we will notify you on this page, by e-mail, or by notification on our Browse page. Your continued use of our service following changes in the privacy policy will demonstrate your acceptance of the updated policy.

Security

We have extensive security measures in place to protect the use, misuse, loss, or alteration of your information. These measures include the use of Secure Socket Layer (SSL) technology during credit card transactions and administrative access to site data, as well as other proprietary security measures applied to storage and transfers of user information. We will exercise reasonable care in providing secure transmission of information between your computer and our servers, but given that no information transmitted over the Internet can be guaranteed 100% secure, we cannot ensure or warrant the security of any information transmitted to us over the Internet and hence accept no liability for any unintentional disclosure.

While we encourage you to subscribe to all communications, we welcome you to change your email preferences in the Account section of the website.
